Terms & Conditions (Online Buyers)

These Terms & Conditions govern your use of our website and any purchase made through our online store. By placing an order with us, you agree to these terms.

  1. Company Information

  1. Commercial/Business Use Only

The equipment sold on this website is commercial-grade and primarily intended for use in commercial and business settings, including restaurants, food service operations, and commercial kitchens.

Customers purchasing equipment for residential or household use are responsible for confirming that the equipment is suitable for their intended use and that manufacturer warranty coverage applies before purchasing.

  1. Products & Pricing
  • All prices are listed in Canadian dollars (CAD) and are subject to applicable taxes (GST/PST as applicable) unless otherwise stated.
  • We make reasonable efforts to ensure product descriptions, specifications, and pricing are accurate, but errors may occur. We reserve the right to correct pricing or specification errors and to cancel orders affected by such errors, with a full refund offered.
  • Some items are special order or made-to-order through our suppliers/manufacturers; these may not be eligible for cancellation once placed with the manufacturer (see Section 8).
  1. Order Acceptance
  • Your order is an offer to purchase. We reserve the right to accept or decline any order, including for reasons such as product unavailability, pricing errors, or suspected fraud.
  • You will receive an order confirmation email once your order is placed; this does not guarantee stock availability.
  1. Payment
  • Payment is due in full at checkout unless other terms have been arranged directly with BFE (e.g., commercial accounts, deposits on large equipment orders).
  • We accept major credit cards and other standard website payment methods offered at checkout.
  • E-transfer: Interac e-Transfer is available as a payment option. Selecting this option at checkout will display BFE's contact phone number and email so payment can be confirmed and processed directly with our team; the order will be held pending confirmation of the transfer.

5a. Taxes

Applicable sales tax (GST/PST or HST, as applicable) is calculated automatically at checkout based on the delivery address provided by the customer.

  1. Shipping & Delivery
  • Shipping timelines are estimates only and may vary based on manufacturer lead times, freight carrier schedules, and product availability.
  • Freight/LTL delivery of large equipment is typically curbside unless white-glove/inside delivery is arranged, which requires a separate quote from BFE.
  • Title and risk of loss pass to the buyer upon delivery to the carrier, except where BFE arranges its own delivery.
  • Freight damage: Inspect all deliveries before signing. Damage must be noted on the delivery receipt and reported to BFE within 48 hours to qualify for a freight claim.
  1. Site Requirements & Installation

The customer is responsible for confirming, prior to delivery, that the equipment will fit the intended space and that all necessary electrical, gas, plumbing, ventilation, and doorway/access requirements are met for the equipment ordered.

Installation, hookup, and connection of equipment are excluded from the purchase and are the customer's responsibility, unless specifically included in BFE's quote, sales order, or proforma invoice for that order.

  1. Cancellations & Backorders
  • Stock items may be cancelled prior to shipment for a full refund.
  • Special-order, custom-fabricated, or manufacturer-direct items may not be cancellable once the order has been placed with the manufacturer; a cancellation fee may apply.
  • Backordered items will be communicated to the customer with an updated timeline; customers may cancel a backordered item at any time prior to shipment.
  • Nothing in these Terms limits any cancellation or refund right that cannot be excluded under applicable consumer protection legislation.
  1. Warranty
  • Equipment sold by BFE carries the original manufacturer's warranty, applicable to commercial/business use as described in Section 2. BFE does not provide separate extended warranties unless explicitly stated at time of sale.
  • Warranty claims are subject to the manufacturer's terms, including labour/parts coverage, any required registration, and any exclusions for residential/non-commercial use.
  • Certified installation: Some equipment (e.g., gas, electrical, or refrigeration equipment) requires installation, connection, and/or commissioning by a licensed or certified technician in accordance with manufacturer specifications and applicable codes. Where such requirements apply, the manufacturer's warranty may be voided if installation is not performed by a licensed/certified technician. It is the customer's responsibility to arrange qualified installation for such equipment.
  1. Returns

  1. Limitation of Liability

To the extent permitted by law, BFE's liability for any claim related to a purchase is limited to the purchase price of the item in question. BFE is not liable for indirect, incidental, or consequential damages (e.g., lost business income due to equipment downtime).

  1. Quotes, Sales Orders & Proforma Invoices

Many larger equipment orders are arranged through a quote, sales order, or proforma invoice rather than the standard website checkout. Where such a document contains terms specific to that order, those terms will take priority over these general website Terms & Conditions in the event of any conflict.

  1. Intellectual Property

All content on this website (text, images, logos) is the property of Budget Food Equipment or its licensors and may not be reproduced without permission.

  1. Governing Law

These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein.
